Terms of service

The agreement between you and Buybusinessclass Travel, Inc. — how a booking is actually formed, what a quoted fare covers, and the line between what we are answerable for and what belongs to the airline.

The agreement

These terms form a contract between you and Buybusinessclass Travel, Inc., a Delaware corporation with its principal office at 180 North Stetson Avenue, Chicago, IL, 60601. By searching, booking or otherwise using this site you accept them. If you are booking for other travellers, you confirm you are authorised to accept these terms on their behalf and to supply their personal data.

Two other documents form part of this agreement: our privacy policy and our refund policy. Where they conflict with these terms on their subject matter, they prevail.

What we are — and what we are not

Buybusinessclass is a travel agent. We search, price and issue tickets on the stock of the operating carrier, and we act as your agent in dealing with that carrier. Depending on the fare, the ticket is issued on our own accredited plate or on the plate of an accredited ticketing partner acting on our behalf; in either case we are the merchant of record for your payment and your point of contact for the booking. We are not an airline. We do not operate aircraft, employ crew, control schedules, decide whether a flight departs, or handle your baggage.

Why this distinction matters
Your transport contract is with the airline named on the ticket, on that airline's conditions of carriage. Claims about delay, cancellation, denied boarding, baggage or on-board service lie against the carrier. We will help you pursue them, but we cannot assume them.

Eligibility

  • You must be at least 18 and able to enter a binding contract.
  • You must use a payment method you are authorised to use.
  • Details you give us — names, dates of birth, document numbers — must be accurate and match the traveller's passport exactly.
  • Unaccompanied minors, expectant travellers past a carrier's cut-off, and passengers needing medical clearance are subject to the operating carrier's own conditions, which we will tell you about before ticketing.

A name that does not match the travel document is the single most common reason a traveller is refused boarding. Carriers permit only limited corrections after issuance, and some permit none. Check the spelling before you pay.

How a booking is formed

Fares shown in search results are live quotes, not offers capable of acceptance. Premium cabin inventory moves quickly and a fare can be withdrawn by the carrier between the moment you see it and the moment you pay.

  • Selecting an itinerary holds a price indication only. Nothing is reserved.
  • Submitting payment authorises us to attempt issuance at the price displayed.
  • A contract is formed — and your card is charged — only when the carrier confirms ticket issuance and we send you a confirmation with a ticket number.
  • If issuance fails, any authorisation is released in full, usually within three to five business days depending on your issuer.

Where an obvious pricing error occurs — a fare materially below the market that any reasonable traveller would recognise as a mistake — we may decline to issue and will refund you in full. We will not use this clause to walk away from a fare simply because it turned out to be unprofitable.

Prices, taxes and fees

Prices are quoted per traveller in US dollars unless stated otherwise, and include the base fare, carrier-imposed surcharges, government taxes and airport charges applicable at the time of quotation. Our service fee, where one applies, is itemised in the booking summary before you pay.

If you pay in a currency other than the one your card is denominated in, your issuer sets the exchange rate and may add its own charge. That is between you and your issuer; we charge the amount displayed.

Payment and fraud screening

Payments are processed over PCI DSS Level 1 infrastructure with 3-D Secure authentication. We hold a token, never your full card number. Every transaction is screened for fraud, and we may ask you to verify your identity or the cardholder's before issuing.

We may decline or cancel a booking where screening is not satisfied, where the card is reported compromised, or where we reasonably suspect the booking is for resale in breach of carrier rules. Where we do, we refund in full.

Changes, cancellations and refunds

Every ticket is governed by the fare rules of the fare purchased. Those rules — and our fees for administering them — are set out in full in the refund policy, which forms part of this agreement.

  • Bookings originating in the United States may generally be voided within 24 hours of issuance when made seven or more days before departure.
  • Voluntary changes are subject to the carrier's penalty, any fare difference, and our service fee.
  • Where the carrier cancels or materially reschedules, you are entitled to rebooking or a refund of the unused portion, and we charge nothing to arrange it.
  • Cancel before the first departure. A ticket left unused past departure normally loses all residual value.

Passports, visas and health requirements

Meeting the entry requirements of every country you travel to or through is your responsibility. This includes passport validity — many destinations require six months beyond your return date — visas, transit visas, electronic travel authorisations, onward ticket evidence and any health documentation in force.

Carriers enforce this at the gate
An airline that boards a passenger who is then refused entry is fined by the destination state, so carriers check documents before departure and will deny boarding where they are not satisfied. A denial on those grounds is treated as a no-show under the fare rules, and no refund is due.

We share what we know and will flag obvious problems, but information we give about entry requirements is a courtesy, not advice. Verify with the relevant embassy or consulate before you travel.

Carrier liability

International carriage is governed by the Montreal Convention 1999 (or the Warsaw Convention where it still applies), which limits carrier liability for death and injury, delay, and baggage. Carriage within a single state is governed by that state's law and the carrier's conditions of carriage.

Passengers on flights to, from or within the European Union and the United Kingdom may also hold rights under EC 261/2004 and its UK equivalent, including compensation for cancellations and long delays within the carrier's control. Those rights are exercised against the operating carrier; we will provide the documentation you need to claim.

Our liability

We provide our service with reasonable skill and care, and we are liable for loss caused by our own negligence or breach of these terms. Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded — including your rights under mandatory consumer law.

Subject to that, we are not liable for acts or omissions of the operating carrier or any other independent supplier, for events beyond our reasonable control, or for indirect or consequential loss. Our aggregate liability in connection with a booking is limited to the total amount you paid us for it.

Acceptable use

  • Do not scrape, mirror or systematically extract fare data from this site, or use automated means to query it beyond ordinary personal use.
  • Do not make speculative, duplicate or fictitious bookings, or book with no intention to travel.
  • Do not engage in hidden-city, throwaway or back-to-back ticketing. Carriers treat these as fare-rule breaches and may invalidate the ticket, bill the fare difference or close a frequent-flyer account.
  • Do not resell tickets issued through buybusinessclass without our written agreement.

The site, its design, text and data compilations are owned by buybusinessclass or its licensors. Airline names and marks belong to their respective owners and are used to identify carriers and their services.

Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to conflict of law rules, and the state and federal courts sitting in New York County have exclusive jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of mandatory provisions of your local law, and you may bring proceedings in the courts of your place of residence.

General

If any provision is found unenforceable, the rest remains in force. Our failure to enforce a term is not a waiver of it. We may update these terms; the version in force when your ticket was issued governs that booking, and material changes will be announced here before they take effect. You may not assign this agreement without our consent; we may assign it to a successor of our business.
